Land Clearing Regulations: What You Need to Know Before Starting Work

Thinking about clearing land on your Mid North Coast property? Whether you’re preparing for a new build, reclaiming overgrown areas, or managing bushfire risk, it’s essential to understand the land clearing regulations that may apply. Failing to follow the rules can lead to heavy fines or delays in your project.

At Vegetation Management Mid North Coast, we help clients navigate local requirements and clear their land the right way.

Why Are There Regulations Around Land Clearing?

Land clearing can impact the environment, biodiversity, waterways, and neighboring properties. That’s why various government agencies—including your local council and the NSW Government—have guidelines in place to regulate when, where, and how vegetation can be removed.

When Do You Need Approval to Clear Land?

In NSW, you may need approval if:

  • Your property is located in an environmentally sensitive area or coastal protection zone

  • The land is covered by native vegetation regulations under the Local Land Services Act

  • You’re near creeks, wetlands, or other protected ecosystems

  • The work involves clearing large areas or removing native trees

Small-scale clearing (like slashing grass or mulching invasive shrubs) often does not require approval, especially for routine maintenance or firebreak creation—but it’s always best to check.

What About Firebreaks or Asset Protection Zones?

The 10/50 Vegetation Clearing Scheme allows property owners in designated bushfire-prone areas to:

  • Remove trees within 10 metres of a home

  • Clear vegetation within 50 metres of a home
No approval is required under this scheme—but your property must be in an eligible zone, and certain restrictions still apply.

Penalties for Unauthorized Clearing

Clearing vegetation without the proper permissions can result in:

  • Fines up to hundreds of thousands of dollars

  • Stop work orders

  • Mandatory rehabilitation of the site

Don’t risk it—make sure your land clearing is legal and compliant from the start.
